2014 Health Care Reform: Be Prepared! What You Need to Know and Do Now to Avoid Significant Penalties

Warren E. Kingsley, leader of the Employee Benefits and Executive Compensation Practice, and Douglas A. Smith, of counsel in the Employee Benefits and Executive Compensation Practice, held a complimentary webinar in June on healthcare reform issues that businesses face. Mr. Kingsley and Mr. Smith discussed the Affordable Care Act as it stands today following the presidential election and the Supreme Court decision upholding the law. Specifically, they addressed:

  • The individual mandate, Medicaid expansion, and the state-based health insurance exchanges.
  • Applicable large employers subject to the employer (“pay or play”) mandate—what is the threshold, what employees are taken into account, and what are the consequences. 
  • The pay or play penalties—general rules, application and calculation of the penalties, and determination of "full-time" employees taken into account. 
  • Employer compliance—affordability/minimum value, premium-setting strategies, and managing health care costs. 
  • Reporting and disclosure obligations. 
  • Other impending Affordable Care Act requirements.
